This Privacy Policy (“Policy”) explains how (the "Website") and any mobile applications that we may issue (the “Apps”) collect and otherwise process personally identifiable information, including Job Posting Information as defined below (collectively, "Personal Information"). Please note that this Policy does not apply to Personal Information collected in our Rewards Program or Rewards App, which are governed by a separate policy available at (the “Rewards Privacy Policy”). You may choose to submit Personal Information (such as your name, address, e-mail address and telephone number) to us at several different points on our Website and through the Apps. We collect, use and disclose Personal Information for business purposes only unless otherwise set out herein. We will not share this information other than as we disclose in this Policy. The Website is owned and operated by Hard Rock Cafe International (USA), Inc. ("Hard Rock", “we”, “us” or “our”). This Policy applies only to the Website and to our Apps (except for the Rewards App, which is governed by the Rewards Privacy Policy). Hard Rock is the sole owner of the information collected on the Website or through the Apps.


The Website and the Apps contain links to other sites whose privacy policies may differ from those of Hard Rock which we recommend you carefully review and consider. We cannot be responsible for the privacy policies and practices of other websites even if you access them using links from our Website or the Apps.


We collect Personal Information from the Website or the Apps in the following ways:

Information We Collect Directly From You.  We collect Personal Information directly from you when you use our Website or Apps as follows:

  • From time-to-time our Website or Apps may request information from you via surveys, promotions, sweepstakes, competitions or contests. Participation is completely voluntary. Requested data may include your contact information, date of birth, marital status, number of children and their ages, and your opinion/answers. Contact information will be used to administer your participation in a promotions, sweepstakes, competition or contest, and to notify the winners and award prizes. Survey information will be used for purposes of monitoring or improving the use and satisfaction of the Website and Apps and our other products and services.< >.  We collect your name and email address when you sign up to receive emails or newsletters about Hard Rock promotions, products and services. You may be required to register in order to use certain features of the Website or the App.  In connection with such registration, we may collect your name, email address, user name, password and security question/answer.  We use this information to set up and manage your account, communicate with you regarding your account and any transactions conducted though the account, to confirm eligibility for use of the online services and to establish the identity of the authorized user. You are responsible for maintaining the confidentiality of your password and user identification.  
  • RockShop Orders.  When you order products from our online RockShop, we will collect your name, shipping address, billing address, phone number, email address and credit card or other payment information.  We use this information to fulfill your orders and process transactions with you and to notify you of products, services and promotions that may be of interest to you
  • Job Applications.  The Website allows you to apply for positions at Hard Rock corporate and cafe locations. We collect the information and resumes that you submit to the third party applicant tracking system described below and when you respond to job postings through the Website.   We and our affiliates and the franchisees and licensees of our cafe locations use this information to evaluate, interview and hire prospective job applicants.  See Job Postings below for more information.

Information We Collect Automatically. We may automatically collect the following information about your use of our Website or Apps through cookies and other technologies: your domain name; your browser type and operating system; web pages you view; links you click; your IP address; mobile device ID and type, the length of time you visit our Website and or use our Apps; and the referring URL, or the webpage that led you to our Website.  We may combine this information with other information that we have collected about you, including, where applicable, your username, name, and other Personal Information. 


If you have provided permission through your mobile device to allow us to collect location information through the Apps, Hard Rock may obtain your physical location information from technologies like GPS, Wi-Fi, or cell tower proximity. The Apps may use the geolocation features of the App (GPS or network-based) and geolocation information that is collected through the Apps to provide you information regarding Hard Rock Cafes and Hotels, events and promotional offers in or near your area or current location. You are able to withdraw your permission for Hard Rock to acquire physical location information from your mobile device through your mobile device settings, although Hard Rock does not control this process. If you have questions about how to disable your mobile device's location services, we recommend you contact your mobile device service provider or the mobile device manufacturer.


The Website may include job postings from time to time for various Hard Rock Cafe locations or our corporate offices. You may be given the opportunity to apply for job openings online through an applicant tracking system operated by iCIMS by creating an account and submitting an application via the Website, which is usually received by the human resources department of the hiring company (which may be Hard Rock or a Hard Rock affiliate or an independent entity). If submitted through that tracking system, your resume or CV and other Personal Information (collectively, “Job Posting Information”) will be made available to the owner, operator or manager of the Hard Rock location or Hard Rock office to which you are applying (which could be a different company from Hard Rock). In addition, your Job Posting Information will be stored in that tracking system in an electronic database maintained by iCIMS in the United States on behalf of Hard Rock and the operators, owners and managers of Hard Rock locations and corporate offices.

In some cases, the Website might list the email address of a contact person at the applicable hiring company. If that hiring company is Hard Rock or a Hard Rock affiliate, any Job Posting Information sent to that email address will be maintained in accordance with this Policy. If that email address is for an independent entity that owns, manages or operates that Hard Rock location, then it will be maintained in accordance with their information practices. You will also be required to create an account with a user name and password when using the applicant tracking system. You are solely responsible for maintaining the confidentiality of that username and password, and for any unauthorized access or use of your user name and password, except where due to the negligence or other fault of Hard Rock.

If at any time you want your Personal Information, resume or CV to be deleted, you simply need to notify the hiring Hard Rock Hotel operator or management company, and in the case of information submitted through the iCIMS tracking system to an independent owner, manager, or operator of a Hard Rock location, you should notify the independent owner, manager, or operator of a Hard Rock location. You may also contact iCIMS directly as stated in the iCIMS privacy policy,


We may use information we have collected and aggregated, or anonymized Personal Information received from third parties, to understand more about our users (for example, we may use aggregated information to calculate the percentage of our users who have a particular telephone area code). This includes demographic data, such as date of birth, gender and marital status, inferred commercial interests, such as favorite products or hobbies, and other information we may collect from you or from third parties (“Aggregate Information”).

Because Aggregate Information does not personally identify you, such information may be disclosed for any purpose where permitted by law.  In some instances, we may combine Aggregate Information with Personal Information. If we do combine any Aggregate Information with Personal Information, the combined information will be treated by us as Personal Information in accordance with this Privacy Policy.


In addition to the specific purposes discussed above, we generally use Personal Information we collect for the following purposes:

  • To provide our Website, Apps and services to you, to communicate with you about your use of our Website, Apps and services, to respond to your inquiries, to fulfill your orders, and for other customer service purposes.
  • To tailor the content and information that we may send or display to you, to offer location customization, and personalized help and instructions, and to otherwise personalize your experiences while using the Website, Apps or services.
  • For marketing and promotional purposes. For example, we may use your information, such as your email address, to send you news and newsletters, special offers, and promotions, or to otherwise contact you about products or information we think may interest you. We also may use the information that we learn about you to assist us in advertising our products and services on third party websites.
  • To better understand how users access and use our Website, Apps and services, both on an aggregated and individualized basis, in order to improve our Website, Apps and services and respond to user desires and preferences, and for other research and analytical purposes.


We share your Personal Information with third parties in the following circumstances:

  1. Hard Rock Affiliates and Franchisees and Licensees:  We may share Personal Information with our corporate affiliates and subsidiaries as well as with third-party owners and operators of franchised or licensed Hard Rock Cafes, Hotels or Casinos.  For example, Job Posting Information is shared with Hard Rock affiliates and independent operators and/or managers of the Hard Rock locations.
  2. Business Partners:  We may partner with other companies to provide you with products, services, or offers based upon your experiences at our cafes and may share your information with our business partners accordingly.
  3. Co-Sponsors of Promotions:  We may co-sponsor promotions, sweepstakes, prize draws, competitions or contests with other companies, and we provide prizes for sweepstakes and contests sponsored by other companies. If you enter one of these sweepstakes or contests, we may share your information with the co-sponsor or third-party sponsor.
  4. Third-Party Service Providers:  During the course of business, we may disclose, transfer or otherwise make available Personal Information to our affiliates and third-party service providers who have been legally contracted to provide services on our behalf, and are prohibited from using it for any other purpose. Job Posting Information is shared with independent operators and/or managers of the Hard Rock locations, and Hard Rock and its affiliates as discussed above and with the iCIMS platform that we use to process such information.
  5. Your Personal Information may be maintained and processed by our affiliates and third party service providers in the US, Canada or other jurisdictions. Third-party vendors that may receive Personal Information include payment card processors and financial institutions for transactions and financial management; on-line Rock Shop and retail product vendors, prize fulfillment companies, travel agencies, on-line reservation service providers, on-line job applicant service providers, survey research firms, and website analytics firms.
  6. Legal Requirements: In addition, we may need to disclose Personal Information to local, state, federal and foreign governmental authorities to comply with legal, regulatory, reporting or administrative requirements, or to an investigative body in the case of a breach of an agreement or contravention of law, or as otherwise required by applicable law.
  7. Defense of Claims/Investigations:  We may also disclose your Personal Information where necessary for the establishment, exercise or defense of legal claims, to investigate or prevent actual or suspected loss or harm to persons or property, or as otherwise permitted by law.
  8. Transfer of Business:  We may transfer your Personal Information as an asset in connection with the sale or transfer of all or part of our business (including transfers made as part of insolvency or bankruptcy proceedings) or as part of a corporate reorganization or other change in corporate control.


In certain jurisdictions, you may have the right not to provide Personal Information. However, if you elect not to provide such information, you may not be able to utilize certain services on the Website or the Apps.


Some information that we collect about you is collected passively through the use of "cookies." Cookies are small files of information, which save and retrieve information about your visit to the Website - for example, how you entered and navigated our Website, and what information was of interest to you. We use this information to remember you when you return and to customize our Website to your preferences.

There are two types of cookies: session and persistent cookies.

  • Session Cookies. Session cookies exist only during an online session. They disappear from your computer when you close your browser or turn off your computer. We use session cookies to allow our systems to uniquely identify you during a session or while you are logged into the Site. This allows us to process your online transactions and requests and verify your identity, after you have logged in, as you move through our Site.
  • Persistent Cookies. Persistent cookies remain on your computer after you have closed your browser or turned off your computer.

Disabling Cookies. Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Visitors to our Site who disable cookies will be able to browse certain areas of the Site, but some of the Site’s features may not function.


Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in the Cookies section (e.g., by disabling cookies). Please note that Hard Rock does not collect, and is not aware of third parties that collect, from users of the Website Personal Information about users’ online activities across third party websites.


Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (a.k.a. web beacons, web bugs or pixel tags), in connection with our Website to, among other things, track the activities of Website visitors, help us manage content, and compile statistics about Website usage. We and our third party service providers also use clear GIFs in HTML e-mails to our customers, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.


We use automated devices and applications, such as Google Analytics, to evaluate usage of our Site. We also may use other analytic means to evaluate our services. We use these tools to help us improve our services, performance and user experiences. These entities may use cookies, tracking pixels and other tracking technologies to perform their services. We do not share your Personal Information with these third parties.


When required in your jurisdiction, Hard Rock will permit individuals to access, correct, amend or delete Personal Information that is demonstrated to be inaccurate or incomplete. If you request access, correction, amendment or deletion of your Personal Information and you have more than one account with us, you will need to instruct us on each account separately. You may make a request for information by completing this form. Reasonable access to Personal Information will generally be provided within thirty (30) calendar days at no cost to you, subject to limited exceptions prescribed by law. Please note that personal profile information supplied by you on-line at the Website can be accessed by you online at any time and at no charge.


We ask users to opt-in to receiving emails and newsletters regarding Hard Rock promotions, products and services.  You can opt-out of receiving such emails and newsletter by using the unsubscribe mechanism in the email.


We may, under limited circumstances, send you offers for related products or services from affiliated Hard Rock companies or jointly offered by Hard Rock together with select third parties. These offers are sent only to those users who have indicated their acceptance to receiving marketing materials from Hard Rock.  You can opt-out of receiving such offers as noted in the section above.


As a global organization, data we collect may be transferred internationally throughout Hard Rock's worldwide organization and to Hard Rock’s headquarters in the United States. Some of the jurisdictions to which data is transferred may not provide the same level of privacy protection as your local jurisdiction. By using and purchasing services and submitting Personal Information through the Website or the Apps, you consent to such transfers of your Personal Information. Without such consent, Hard Rock is not able to provide you with access to its online services and other programs made available on the Website or through the Apps.

EU/US Privacy Shield Compliance

Hard Rock complies with the EU/US Privacy Shield framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of Personal Information from European Union member and treaty countries. We have certified that we adhere to the Privacy Shield Principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access, and Recourse, Enforcement and Liability.

Hard Rock Cafe International (USA), Inc. has provided a private sector independent recourse mechanism (located in the United States) to investigate and expeditiously resolve individual complaints and disputes. This dispute mechanism will cover all personal data except for human resource data. If Hard Rock transfers your personal data to a third party, we will ensure the third party is contractually obligated to process your data only for limited, specific purposes consistent with this policy, to apply the same level of protection to that data as the EU-U.S. Privacy Shield Principles, and notify us if it makes a determination that it can no longer meet this obligation. Upon notice, Hard Rock will take reasonable and appropriate steps to stop and remediate unauthorized processing. In cases of onward transfer to third parties of data received pursuant to the EU-US Privacy Shield, Hard Rock is potentially liable.


The Website or the Apps may make chat rooms, forums, message boards, and/or news groups available to its users. Please remember that any information you disclose in a public forum will be available to other visitors to our Website or other users of the Apps. To the extent you disclose your Personal Information in such public forums, the use of the information by third parties who access it there will not be subject to this Policy.


Hard Rock Cafe is mindful of the privacy of children. For that reason, we never collect or maintain information at our Website or through our Apps from those we actually know are under 13.


Users who no longer wish to receive our newsletter or promotional materials may opt-out of receiving these communications by clicking the unsubscribe link at the bottom of the email or contacting customer care.

We aim to keep our information about you as accurate as possible. If you would like to access, update, review or change the details you have supplied us with, please complete this form. This privacy policy is effective as of January 1, 2019. If we make any changes to our Policy, we will post the updated Policy to the Website, provided on an updated homepage link, and may post it to other places we deem appropriate. We process the Personal Information collected for the purposes described in the section WHAT INFORMATION WE COLLECT AND HOW WE USE IT in our Privacy Policy. The legal bases for our processing activities include processing Personal Information as necessary to comply with our contractual obligations, compliance with our legal obligations, protecting the safety of our employees, guests and others, for our legitimate business interests, and pursuant to your consent. The particular legal basis for the processing of your Personal Information is based on the purpose for which such information was provided or collected.

For example, we use Personal Information as necessary for the performance of contracts with you, or in order for us to take steps, at your request, prior to entering into a contract, such as the purchase of our products and services from the online Rock Shop.  For example, we are not able to provide our services and products according to contracts unless you provide us with necessary Personal Information. This collection and processing of the Personal Data is based on Art. 6 para. 1 (b) GDPR (necessary for the performance of a contract with you).

We may also process your Personal Information if we have received your consent, to respond to requests from you or to take actions in our legitimate interest, such as for marketing purposes or to otherwise inform you of our business operations, and to improve our products and services. Please note that if we rely on consent, you may withdraw your consent at any time, but such withdrawal will not affect the lawfulness of the processing prior to the withdrawal. This collection and processing of the Personal Data is based on your consent in accordance with Art. 6 para. 1 (a), 7 GDPR.


We retain Personal Information about you for the time necessary to accomplish the purpose for which such information was collected, usually for the duration of any contractual relationship and for any period thereafter as legally required or permitted by applicable law. Our retention policies reflect applicable statute of limitation periods and legal requirements.


Residents of the EEA have the following rights:

    • receive information on how your Personal Information is processed

  • Right to Object to Processing: You have the right to request that Hard Rock cease processing of your Personal Information: for marketing activities, including profiling for statistical purposes where such processing is based on our legitimate business interests, unless we are able to demonstrate a compelling legitimate basis for such processing or we need to process your personal information for the establishment, exercise or defense of a legal claim.
  • Right to Restrict Processing: You have the right to request that Hard Rock limit the processing of your Personal Information:
    • while we are evaluating or in the process of responding to a request by you to update or correct your personal information where such processing is unlawful and you do not want Hard Rock to delete your data
    • where Hard Rock no longer requires such data, but you want us to retain the data for the establishment, exercise or defense of a legal claim
    • where you have submitted an objection to processing based on our legitimate business interests, pending our response to such request

Where we limit the processing of your Personal Information pursuant to your request, we will inform you prior to re-engaging in such processing.

  • Data Portability Requests: You have the right to request that we provide you or a third party that you designate with certain of your Personal Information in a commonly used, machine readable format. Please note, however, that data portability rights apply only to Personal Information that we have obtained directly from you and only where our processing is based on consent or the performance of a contract.

Submitting Requests: You can submit requests by completing this form.  We will respond to all such requests within 30 days of our receipt of the request, unless there are extenuating circumstances, in which event we may take up to 60 days to respond. We will inform you if we expect our response to take longer than 30 days. Please note, however, that certain Personal Information may be exempt from such rights pursuant to applicable data protection laws. In addition, we will not respond to any request unless we are able to appropriately verify the requester’s identity. We may charge you a reasonable fee for subsequent copies of Personal Information that you request.

We use Personal Information to divide large groups of consumers into sub-groups of consumers (known as segments) based on some type of shared characteristics such as geography, behavior, or demographics.


We may transfer the Personal Information we collect about you pursuant to the purposes described in Privacy Policy to countries that have not been found by the European Commission to provide adequate protection. In particular, we transfer your personal information to the United States.   Please note that we comply with the EU-US Privacy Shield Framework as noted in the Privacy Policy.  We also implement appropriate safeguards for the transfer of Personal Information among our affiliates and with third parties in various jurisdictions, and where required, we have implemented European Union controller-to-controller and controller-to-processor standard contractual clauses or other such safeguards for such purposes. California residents who have provided Personal Information to Hard Rock may obtain information regarding Hard Rock's disclosures, if any, of Personal Information to third parties for third-party direct marketing purposes. This request may be made no more than two times per calendar year. We reserve our right not to respond to requests if they are not submitted to the address specified in this paragraph.
